Asbestos Attorney Mesothelioma - Law

Mesothelioma, sometimes called "asbestos disease" is type of cancer which is relatively rare and affects approximately one person in a million. The usual cause of this disease is exposure to asbestos.

The first litigation on this subject happened in 1929, and large numbers of lawsuits have been filed since 1960 when it was medically established that mesothelioma was directly caused by exposure to asbestos while mining asbestos. In 1965 it was established that exposure to asbestos, even when not working in a mine, could cause mesothelioma.

Legal procedings regarding asbestos exposure are most common in USA, UK and Australia, although sometimes happen in other countries too.

Compensation claims for mesothelioma resulting fom asbestos exposure can be considerable, sometimes in excess of several million dollars. Compensation can be paid for a variety of elements including the disease itself, loss of earnings, items purchased due to the disease, compensation from care provided whether paid-for or not, loss to other family members as well as travel to medical facilities.

Some legal professionals will sometimes handle a mesothelioma on a "no win no fee" basis so there is no initial cost to the claimant. Cases are often settled before the final hearing, which in practice means that the claimant rarely has to appear in court. A claimants application for state benefits can sometimes make a difference to a claim, but will rarely prevent a claim from being made.

Professions where mesothelioma due to asbestos exposure is most common include biolermakers and laggers as asbestos was commonly used as lagging to insulate boilers, electricians, joiners, carpenters, and builders who cut or drill asbestos insulation in the course of their work, motor mechanics exposed to asbstos in brake pads and clutches, pipe fitters and plumbers exposed to asbestos pipe insulatin, as well as fire fighters, police officers, managers, shipbuilders etc.
